It is important that you read these Terms & Conditions before using Swapaholic. By accessing the Swapaholic website or using the Swapaholic service, you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions you may not use this site.
We reserve the right to change these Terms and Conditions at any time, without having to give notice to users. Your continued use of the Swapaholic website shall be deemed to be your acceptance of such change.
These Conditions shall be governed by and interpreted in accordance with English law and the courts of England shall have exclusive jurisdiction to hear all disputes arising in connection with these terms and conditions.
Swapaholic has the right to suspend or terminate any user's access to the Swapaholic website and service if the user breaches any part of this agreement or if Swapaholic deems that the user is performing activities harmful to Swapaholic or is breaching UK law. If we or you terminate your membership (for any reason), you are not entitled to any compensation or refund.
1) You must be 18 years old or over in order to register and to use the Swapaholic site. If you are under 18 you may only use Swapaholic under the supervision of a parent or guardian. You must not use your own name to register with Swapaholic if you are under 18 years old; you must use your parent or guardian's name.
2) When registering with Swapaholic you must provide full and accurate information. If you provide false or inaccurate details when registering as a member we may revoke your membership without notice. You must update your registration details should they change at any time by logging in and visiting the 'My Profile' page.
3) You must be U.K. based to use Swapaholic and the address you register with must be a U.K. address.
4) Swapaholic is not responsible for making sure that users complete swaps. Where a swap is taking place by post, the sender is responsible for all shipping costs. Swapaholic is in no event responsible for any losses of items arising from the use of the Swapaholic web site or service (including the postage process). Nor is it liable for any damages or costs arising from any dispute between members.
5) You must ensure all items that you add are available to swap. If an item becomes unavailable make sure you delete it from your account. When a swap is completed and you have left feedback, your items involved in the swap will automatically be deleted.
6) Swapaholic is merely a service which allows registered users to swap items. Therefore, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings or the ability of users to provide items.
7) If you make an offer to swap which is subsequently accepted by another user, you must complete the swap unless both parties agree to the cancellation of the swap.
8) You must not register or swap items which:
- contain illegal, sexually explicit, pornographic, or obscene material
- are stolen, counterfeit or fraudulent
- infringe any third party's copyright, patent, trade mark, trade secret or other proprietary rights.
- you are not legally able to trade
- are defective or in a condition that is unusable
9) Swapaholic reserves the right to remove any item listed at its sole discretion and without notice.
10) We reserve the right to change or remove (temporarily or permanently) the website or any part of it without notice and you confirm that Swapaholic shall not be liable to you for any such change or removal.
11) Registering with Swapaholic is currently free. We reserve the right to introduce a membership fee in the future. Existing users will be given at least fourteen days notice of any fees and will be given the opportunity to renew their membership, agreeing to any new terms and conditions. If at the end of this period of notice an existing user fails to renew their membership, we may suspend or terminate their account.
12) You must not transmit through Swapaholic any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise breach any applicable law or regulation. You must not attempt to gain unauthorised access to our computer system or the computer systems of any other member.
13) You agree to meet up in person with other users at your own risk.
14) Swapaholic allows users to leave ratings and feedback comments based on their experience of swapping with other users. You acknowledge and accept that ratings and feedback relating to you will be available for viewing by anybody using the Website. We do not view ratings and feedback, and are not responsible for checking or editing the ratings or feedback on the site. You consent to the publication of ratings and feedback, even though these may be critical or defamatory. You release Swapaholic from, and waive all rights against Swapaholic in relation to any liability in relation to the publication of defamatory comments in ratings and feedback, even though we may be aware of such comments. You agree to indemnify and hold Swapaholic harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to ratings and feedback left by you on the website.
